ELEVATION FITNESS MONTH-TO-MONTH MEMBERSHIP AGREEMENT

BUYER’S RIGHT TO CANCEL

You, the buyer, may cancel this agreement at any time prior to midnight of the seventh (7th) business day after the date of this agreement.

STATE LAW NOTICE

State law requires that we inform you that should you (the buyer) choose to pay for any part of this agreement in advance, be aware that you are paying for future service and may be risking loss of your money in the event this health club ceases to conduct business. Health clubs do not post a bond, and there may be no other protections provided to you should you choose to pay in advance.

  1. NON-DISCRIMINATION. Membership at Elevation Fitness (EF) is open to individuals of good character and responsible background. Membership shall not be restricted or denied based on gender, race, color, ethnic descent, creed, religion, disability, or any other legally protected classification. All applications are subject to final approval by EF at its sole discretion.

  2. REGISTRATION & ACCESS. Members must check in at the front desk and present a valid membership card or credential upon entering the facility. Replacement cards incur a $3.00 fee. Membership cards are strictly non-transferable and for exclusive use by the designated member. Unauthorized use or sharing of a card may result in immediate membership termination and legal action.

  3. AUTO-RENEWING MONTHLY DUES. This is a month-to-month agreement with no long-term commitment. Monthly dues will automatically be debited from the member’s designated checking account, credit card, or debit card on the same day of each month. Members are responsible for maintaining sufficient funds and current payment details. Failed transactions will incur applicable bank/processing fees, and late payments may result in suspension of access until the account balance is made current.

  4. 30-DAY CANCELLATION POLICY. Following the initial statutory 7-day cancellation window, members may cancel their month-to-month membership at any time by providing 30 days’ prior written notice to EF. Written notice must be delivered in person to the facility where the membership was purchased or sent via certified mail (return receipt requested). Verbal or phone cancellations are not accepted. The member remains responsible for any billing date that falls within the 30-day notice period.

  5. MEMBERSHIP FREEZE. Freezing a membership is subject to sole approval by EF. Requests must be submitted in writing with supporting documentation (e.g., medical or travel verification).

  6. DISABILITY OR DEATH.

    • Temporary Disability: A member may extend their membership term without penalty for a period equal to the duration of a temporary disability (verified in writing by a licensed physician) that prevents use of the facility.

    • Permanent Disability or Death: A membership will be canceled upon receipt of written verification from a physician confirming permanent disability, or upon proof of death. Billing will cease within 10 days of receiving valid verification.

  7. LIABILITY WAIVER & PROPERTY RELEASES. Members are strongly encouraged to consult a physician prior to starting any exercise routine. Participation in activities at EF is purely voluntary. Members assume all inherent risks of physical activity and agree that EF, its owners, employees, and agents shall not be liable for injuries or damages arising from facility use. EF is not responsible for lost, stolen, or damaged personal property brought into the facility.

  8. GOVERNING LAW & LEGAL FEES. This agreement is governed by the laws of the State of Georgia. If EF must take legal action to collect unpaid dues or enforce terms, the member agrees to pay all reasonable attorney fees and court costs incurred by EF.

FARMHOUSE COFFEE MEMBERSHIP PERK ADDENDUM

COMPLIMENTARY DRINK BENEFIT

Active members receive up to four (4) complimentary beverage credits per monthly billing cycle, redeemable at Farmhouse Coffee under the following terms:

  • Eligible Items: Credits apply strictly to handcrafted coffees, smoothies, and teas. Pre-packaged or bottled beverages of any kind are excluded.

  • Location Restriction: Valid exclusively at the Farmhouse Coffee counter located inside Elevation Fitness.

  • Monthly Limit & No Rollover: A maximum of four (4) free drinks may be claimed per monthly billing cycle. Unused credits automatically expire at the end of each billing cycle and will not roll over, accumulate, or transfer to subsequent months.

  • No Cash Value or Transfers: Beverage credits hold zero cash value, are non-transferable, and cannot be redeemed for cash, gift cards, or retail items.

  • No Dues Discounts: Beverage credits cannot be applied as a discount, credit, or offset against monthly membership dues or any other facility fees.
